What is covered by this Limited Warranty?
SafetyMate, Inc. warrants this product to be free from defects in materials and workmanship for a period of one (1) year from the date of purchase by the original purchaser. This limited warranty is a purchaser’s exclusive remedy, and applies as follows to new products. Any statement or representation made by any person regarding SafetyMate, Inc.’s warranty obligations is void, except as provided in this written limited warranty.

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL BE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. OTHERWISE, THE REPAIR, REPLACEMENT OR REFUND AS PROVIDED UNDER THIS EXPRESS LIMITED WARRANTY IS THE EXCLUSIVE REMEDY OF THE PURCHASER, AND IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

IN NO EVENT SHALL SAFETYMATE, INC. BE LIABLE, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE PRODUCTS TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

What is not covered by this Limited Warranty?
This limited warranty does not cover:

• Periodic maintenance, repair and replacement of parts due to normal wear and tear;
  
• Any failure of performance as a result of misuse, abuse, abnormal usage, neglect, improper return shipping, or natural disasters;
  
• Defects or damage that result from improper operation, storage, misuse, abuse, accident, vandalism, or neglect;
  
• Defects or damage that result from contact with liquid, water, rain, extreme humidity, extreme heat, heat sources, food products or heavy sand, dirt or the like;
  
• Defects or damages resulting from service, testing, adjustment, installation, maintenance, alteration, or modification in any way by anyone other than SafetyMate, Inc. or its authorized representatives;
  
• Products with serial numbers or date tags that have been removed, altered, or obliterated;
  
• Products with broken seals or that show evidence of tampering;
  
• Products with mismatched board serial numbers; or
  
• Products with nonconforming or non-SafetyMate housings or parts.
  

Who is covered by this Limited Warranty?
This limited warranty extends only to the original purchaser, and is not transfer-
able.
